OWF with 11g DB legal question

IHAC with a valid license for Oracle Database 11g (support included).
They use Oracle Workflow for some custom applications in a 10g DB.
Since OWF is not more available in 11g the question is:

Can they use OWF (from 10g) in a 11g database from a legal point of view (even it is not supported) ?
They states that OWF support is not a problem because the applications are very stable and they know everything about the OWF internals.
