Licensing - Standard Edition 2

Hi,

Oracle Standard Edition 2 license limits max sockets to 2 and CPU threads to 16.

My question is ->  Cpu threads limitations, is a contract limitation or a technology limitation?

I mean, imagine I buy one server with two 10 core servers. (20 cores, with hyperthreading are 40 threads). There is a limitation inside the database to limit to 16 threads with not contract violation, or it will use 40 threads and therefore would be a contract violation?
