license for using BI publisher desktop(RTF file) with Apex

Hi all,

I work with oracle apex applications , and in apex we can generate XML file and use it in  RTF (created by BI publisher desktop) to generate reports.

My question is:

If we have one license for database, is it legal to use BI publisher desktop or should we pay a license for  BI publisher desktop?
