Legal use of OTN downloaded products?

I have a question and I'm pretty sure (99.9999999%) I know the answer, but I wanted to ask anyway.
If we are tasked with evaluating X, Y and Z Oracle software for any potential problems and work out config issues prior to the production roll out our product, can we legally download the available software on OTN and use it during our evaluation without a valid production license? I, without a doubt, know in order to roll into production I need a license. We just want to get the kinks worked out in VMs and junk hardware before the real hardware arrives and roll out.
I was just accused of stealing, in a very hostile tone, while in a meeting because I downloaded software without a license. When I confronted him with OTN page (http://www.oracle.com/technology/software/index.html) and disclaimer, he flat out refused to view the site and would only accept an answer from an Oracle sales rep.
It seems to me that the language on that page is pretty clear, but please let me know if I am mistaken!?
