Fal_client, fal_server triggering when applying with delay .

Hi,
I'm on 10.2.0.3 RAC witn physical standby , old fasion config with no standby redo so shiping only after log switch .
We've got 10h delay and looks like gap resolving via fal client/server is triggered only when the acctual arch log
needs to be recovered and is not found on standby site, no when it is not shipped .
So, is that feature or bug ?
In my understanding gap resolving should trigger as soon as gap is detected ..
Looks like delay we using messed things up .
