ds 5.2 has a "ns-slapd timebomb" when you patch it to patch 5

I have recently patched our directory server infrastructure (hosted on SPARC/Solaris) from 5.2 patch 4 to patch 5:
Sun Java(TM) System Directory Server/5.2_Patch_5 B2007.093.0058.
Now (a few weeks later) I am getting the following error message when I stop and then start the directory server:
[01/Aug/2007:22:05:23 +0100] - DEBUG - conn=-1 op=-1 msgId=-1 - ERROR: ** This beta software has expired **
The directory server will not restart !!
So I have raised a support call with SUN.
I have done a quick search of sunsolve and apparently this issue, which is described as an "ns-slapd time bomb", was present in other releases of 5.2 (but on windows).
It is deeply concerning that the latest 5.2 patch appears to be broken in this way.
Has anyone else experienced this issue with ds 5.2 patch 5 on Solaris ?
